Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Anoshaya LLP (LLPIN: ACD-3528), a Limited Liability Partnership registered in India under the Limited Liability Partnership Act, 2008. These Terms govern your access to and use of all products and services operated by Anoshaya LLP, including ThumbnailCollab, ReachMassive, and any future products we may launch (collectively, the "Services").

By creating an account, subscribing to a plan, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old to use our Services. If you are using the Services on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Accounts

When you create an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Keep your login credentials secure and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Not create accounts using false or misleading information
• Not create multiple accounts to circumvent product limits or restrictions

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our reasonable discretion.

3. Acceptable Use

You agree not to use our Services to:

• Violate any applicable law, regulation, or third-party rights
• Transmit malware, spam, or any harmful or disruptive content
• Attempt to gain unauthorized access to our systems, other users' accounts, or any connected networks
• Scrape, crawl, or use automated means to access our Services without our written permission
• Use our Services for any illegal, fraudulent, or abusive purpose
• Interfere with or disrupt the integrity or performance of our Services

4. Subscriptions and Payments

Some of our products offer free plans with limited features. Paid plans are available on a subscription basis (monthly or annually).

All payments are processed by Lemon Squeezy (Lemon Squeezy LLC), which acts as the Merchant of Record on our behalf. By subscribing to a paid plan, you also agree to Lemon Squeezy's terms of service. Lemon Squeezy handles billing, sales tax, and payment processing.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time from within the product. Cancellation takes effect at the end of the current billing period — you will retain access until then.

We may change our pricing with at least 30 days' notice. Price changes will apply to the next billing cycle after the notice period. Your continued use after a price change constitutes acceptance of the new pricing.

5. Intellectual Property

All content, code, design, features, and functionality of our Services (including but not limited to software, text, graphics, logos, and user interfaces) are owned by Anoshaya LLP or our licensors and are protected by applicable intellectual property laws. You do not acquire any ownership rights by using our Services.

You retain ownership of content you create or upload through our Services. By uploading content, you grant Anoshaya LLP a limited, non-exclusive, royalty-free license to use, store, display, and process that content solely as necessary to provide the Services to you.

6. Service Availability

We strive to keep our Services available 24/7, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend the Services for maintenance, updates, or reasons beyond our control. We will use reasonable efforts to provide advance notice of planned downtime when practicable.

We reserve the right to modify, suspend, or discontinue any product or feature at any time. For significant changes that materially reduce the functionality of a paid product, we will provide at least 30 days' notice and, where appropriate, offer a pro-rata credit for the remaining subscription period.

7. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or free from errors or harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Anoshaya LLP and its partners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Services.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you have paid to Anoshaya LLP in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such cases, our liability will be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Anoshaya LLP, its partners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

10. Termination

You may stop using our Services and delete your account at any time. We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will remain in effect.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

12. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may also notify you by email. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our Services.

13. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Anoshaya LLP regarding your use of the Services and supersede all prior agreements and understandings.
